Spousal maintenance is rarely awarded in divorce, except in marriages of 10 years or more in which the receiving spouse has few assets and a low earning capacity. Alimony, on the other hand, is purely contractual, in the sense that it is agreed upon as part of a divorce settlement negotiated by the spouses' lawyers, and not set by the court.

In a divorce settlement, spouses often agree to tradeoffs between the amount of alimony paid and the division of property. Couples thinking about divorce should be aware that taxation issues can and should play a large role in such tradeoffs.
