Father gets custody of child while mom in pen

After a Texas woman allegedly sent letters to President Barack Obama that were laced with ricin, her estranged husband sought custody of the couple's newborn son. A New Boston judge awarded the father temporary child custody. She was not present during the custody hearing.

The woman is charged with sending ricin-laced letters to the president. to the New York Mayor, Michael Bloomberg, and to a leader of the mayor's gun-control group. She was placed in federal custody to await a competency hearing in Texarkana. She was arrested on June 7 and gave birth less than a month later to a premature baby. She tried to implicate her husband in the crimes, but he has not been charged.

Child custody disputes can become contentious, especially when one party is attempting to show that another parent is unfit. A parent may use a drug charge, conviction or allegations of criminal activity against a parent during a custody battle. A person may also seek sole custody if he or she believes that it is in the best interests of the child for there to be limited contact between the child and the other parent. This situation may also arise if one parent has been absent and has not established a relationship with children belonging to the couple before court proceedings begin.

Texas family law attorneys may be able to assist individuals dealing with family issues. They may help a client to obtain child custody by proving that it is in the best interests of the child. To make this determination, a judge will evaluate several factors, including each parent's relationship with the child, the income of each parent, the morality of each parent and the likelihood of each parent to support the relationship with the other parent.
