Judge dismisses Usher's ex-wife's motion for temporary custody

People in Texas might be interested to hear that Usher's ex-wife reportedly filed a motion with the court for emergency custody of their son after he nearly drowned in a swimming pool. The Georgia judge dismissed his ex-wife's motion, stating that the swimming pool accident the boy was involved in was not an emergency situation that qualified the boys to be removed from Usher's care.

According to the boy's mother, he is still in the hospital, but he is doing much better. The boy's aunt was caring for him at the time the incident occurred. Usher's ex-wife testified that she didn't trust her son being in the care of his aunt. However, according to the Fulton County Superior Court judge, no one could have done better for the boy during the incident than his aunt did. Therefore, Usher will retain primary custody of his children at this time.

The judge also instructed Usher to keep his ex-wife informed about his whereabouts and about who is taking care of their two children. His ex-wife had alleged that he did not keep her informed about such matters. However, Usher stated that he sent her weekly emails detailing the children's activities and that he even gave her any aliases he might be staying under if they traveled. Usher did admit that he waited an hour after his son's swimming accident emergency to notify his ex-wife, but he maintained that was because he had to respond to the emergency first.
